As Voice of OC reported, the local advocacy group Brea4All filed a writ of mandate against the City of Brea and Community Development Director Jason Killebrew in Orange County Superior Court on Sept. 29. The lawsuit alleges violations of the California Public Records Act and the California Constitution regarding text message records concerning a proposed Costco store and gas station at 200 and 250 S. Kraemer Boulevard.

According to the legal filing, the disputed communications involve discussions between Killebrew and developer Dwight Manley about the project and a 50-year Economic Development Agreement approved by the city council. Brea4All claims the city produced incomplete and scrambled PDF screenshots rather than sequential messages in native format.

Developer Dwight Manley told Voice of OC in an email that the project provides significant community and long-term financial benefits. City public information officer Liz Pharis stated that the city has provided responses to public records requests and supplied over 15,000 pages of records.

A status conference is scheduled for Dec. 3 at the North Justice Center in Fullerton.
